On 25 September 2017, the Court of Appeal (“CoA”) of Hong Kong handed down a landmark judgment, allowing an appeal against the Director of Immigration of the Hong Kong Immigration Department’s (“ImmD’s”) decision in rejecting an application for dependent visa for same-sex couples. The CoA directed the ImmD and the appellant to come up with a proposed draft order by consent in respect of the actual relief to be granted for the CoA’s consideration. Or, failing consent, each party should submit their respective proposed draft orders for consideration.
